Pagani Automobili America, Inc. is committed to protecting the information you provide to us. We collect this information for the sole purpose of providing you with the website functionality necessary to access the Pagani Technical Information Portal. By utilizing the Pagani Technical Information Portal, you acknowledge, accept, and agree to the following privacy disclosures and terms.

The Pagani Technical Information Portal is authorized for use only by citizens of the United States of America. More specifically, this Privacy Notice (this "Notice") applies only to personal information collected about individuals in the United States. If you are located in another country, please review the privacy notice of the Pagani entity or website that serves the country where you are located.
2. What this Notice Covers
This Privacy Notice (this "Notice") explains our collection, processing, dissemination and use of your personal information through the Pagani Technical Information Portal website.
This Notice covers and applies to the following:
- Information provided by you when you register to utilize the Pagani Technical Information Portal.
- Information provided to us by your web browser, internet provider, or device when you access the Pagani Technical Information Portal website, including but not limited to your Internet Protocol Address ("IP Address").
- Information collected when you log into the Pagani Technical Information Portal website, which is used to populate a cookie (discussed below).

- Citizens and residents of the United States of America.
3. What this Notice Does Not Cover
This Notice does NOT apply to the following:
- The privacy practices of any website, product, or service offered on or behalf of Pagani Automobili America, Inc., Pagani S.p.A., or any of their affiliates, subsidiaries, parents, successors, or assigns that do not directly link to this Notice.
- Citizens of countries other than the United States of America.
- Any privacy notices that pertain to current or prospective employees, contractors, or applicants related to employment or engagement with any Pagani entity, including but not limited to Pagani Automobili America, Inc. or any products Pagani makes available to the personnel of any entity that have a business relationship with Pagani. The applicable privacy notices for these purposes are available directly from the applicable entity.
- Any content, products, services, websites, mobile applications, platforms, or properties not owned or operated by Pagani.
- The privacy practices of authorized Pagani dealers or service centers, any other entity that sells or services new or used Pagani vehicles, any advertising networks affiliated with any Pagani dealers or service centers (whether or not authorized), or any associations to which any of the foregoing may belong.
4. Types of Personal Information We Collect
The type and amount of information we collect depends on the choices you make as you interact with the Pagani Technical Information Portal website. We collect personal information about you in different ways and from different sources, as described below.
a. Information You provide to Us.
As you use the Pagani Technical Information Portal website, you may choose to provide information to us, including when you create or modify an account with us, download materials hosted on the website, or make a purchase. 5. Cookies and Related Technology
The Pagani Technical Information Portal website uses a functional cookie to provide you with access to the information on the website.
A cookie is a small text file or piece of computer code placed on your device’s hard drive to store data that can be recognized by a server on the same domain that placed the cookie. 6. Data Controller and Processor; Location of Data.
Pagani Automobili America, Inc. shall be the data controller with respect to all personal data subject to or obtained under this Notice. Pagani S.p.A. shall act as data processor pursuant to a Data Processing Agreement with Pagani Automobili America, Inc. and has appointed Aidoc S.R.L. as Sub-Processor pursuant to a Data Processing Agreement.
Personal data subject to or obtained under this Notice will be processed and stored in the European Union.
7. Purposes of Data Collection
We use the personal information we collect for purposes described in this Notice, or as separately disclosed to you or your employer in a separate contract. We may use such personal information for the following purposes:
- To operate and manage the Pagani Technical Information Portal, including:
- To operate and manage provide you with access to the Pagani Technical Information Portal;
- To create your account registration and manage your account information; and
- To access the materials within the secured portion of the Pagani Technical Information Portal website; and
- To improve your experience within the Pagani Technical Information Portal website, including troubleshooting, operating, and securing the website.
- To operate our business and perform business functions, including:
- Conducting accounting, finance, and tax-related activities;
- Ensuring regulatory compliance;
- Evaluating compliance with contracts;
- Defending against and prosecuting litigation;
- Ensuring information security; and
- Detecting and preventing fraud.
- To comply with and support all applicable laws, including:
- Compliance with valid inquiries and directives from law enforcement or other government agencies; and
- To protect the rights or property of others.
8. Legal Basis for Processing Personal Information.
We collect and process your personal data for the purposes described in the section "Purposes of Data Collection" on one of the following legal bases:
- The processing of your personal information is necessary for performance of a contract with you (or your employer) or in order to take steps prior to entering into a contract with you at your request.
- The processing is necessary for the purposes of our legitimate interests, and such interests are not overridden by your interests or fundamental rights and freedoms. The legitimate interests we pursue include our interest to manage and maintain the contractual relation between us, to answer your specific questions, and to provide you with access to the materials you have contracted to receive.
9. Length of Retention and Processing of Personal Information.
We retain personal information for only the time necessary to achieve the specific data processing purposes described above, including providing you with access to the Pagani Technical Information Portal, to fulfill your subscription period, comply with our legal obligations, resolve disputes, enforce contracts, and other legitimate and lawful business purposes. Because these needs vary widely for the different types of information we collect, the period of processing/retention can vary significantly, but may be up to ten years after the end of our contractual relationship with you, unless a shorter or longer period applies under applicable laws.
10. Your Control over Personal Information.
You can access, edit, correct, or delete some of the personal information we have collected by logging into your account accessing the information in your account profile.
11. When We Disclose Personal Information.
We disclose your personal information only as necessary to provide access to the Pagani Technical Information Portal, as necessary to complete your subscription, and to accomplish the purposes set out in this Notice. For example:
- Data Processing: We disclose your information for processing to the entities discussed above. Such processing is limited to the purposes identified in this Notice.
- Payment and Contractual Purposes: We disclose information related to your purchase of a subscription to our selected payment processor, banks, or other entities as necessary for payment processing, fraud prevention, or other related financial purposes.
- Law Enforcement Agencies, Courts, Regulatory Agencies, and others: We will disclose personal information when we believe that it is necessary to:
- Comply with applicable law or respond to legal process, including from law enforcement agencies;
- Detect, investigate, or prevent fraud or privacy concerns;
- Operate and maintain the security of the Pagani Technical Information Portal or other web services, including to detect, investigate, prevent, stop, or remediate an attack on our computer services or networks; or

Similarly, this California Notice does not apply to current or former Pagani employees or contractors, who have separate Notices in that capacity.
This California Notice supplements the Notice and provides additional information for California residents. In the event of a Conflict between the California Notice and the remainder of this Notice, the California Notice shall prevail as to California Residents’ rights under the CCPA. Capitalized terms herein shall have the same meaning as the same terms defined in the CCPA.

The CCPA gives California residents certain rights; we will verify your identity before honoring certain requests to exercise those rights (including those made by authorized agents).
- Right to Access: You have the right to request, up to twice per year, that we provide you with the following information:
- The categories and specific the categories and/or specific pieces of personal information we have collected about you;
- the categories of sources for that personal information;
- the purposes for which we use that information;
- the categories of third parties with whom we disclose the information; and
- the categories of information that we sell or disclose to third parties.
- Right to Delete: You have the right to request that we delete personal information that we collected from you, subject to certain exceptions.
- Right to Opt-Out of Sale or Sharing: You have the right to request that we stop selling or sharing your personal information ("opt-out"), including via a user-enabled global privacy control.
- Right to Correct: You have the right to request that we take commercially reasonable efforts to correct inaccurate information about you in our records. We may request documentation in connection with your request. You can also correct certain Personal Information that we maintain about you by logging into your Pagani Technical Information Portal account.
- Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to direct us to only use your Sensitive Personal Information (e.g. Social Security number, financial account information, precise geolocation data, or genetic data) for limited purposes, such as providing you with the services you requested.
- Right to Non-Discrimination: You have a right not to be discriminated against for exercising rights under the CCPA.
h. How to Exercise Your Rights under the CCPA.
You can exercise your rights under the CCPA by sending a request to Pagani using the methods on the "Contact us" page of the Pagani Technical Information Portal website.
If you want to exercise more than one of your CCPA rights, please submit each request separately, so we can track your requests and respond efficiently, including if we need to ask for additional information.
We will need additional information from you to confirm that you are a California resident, determine if we have Personal Information about you, and verify your identity (for certain requests). We may not be able to honor your request for certain reasons set forth under the CCPA, such as if we have a legal obligation to maintain your Personal Information or if we are not able to verify your identity.
You may make a request to exercise your rights under the CCPA through an authorized agent, either in writing or through a power of attorney. However, before we can accept a request from an authorized agent, we will require the agent to provide proof that they are acting on your behalf, and we may need to verify certain information directly with you.
i. Shine the Light.
California Law permits California Residents to request certain details about how their Personal Information is shared with third parties, and in some cases affiliates, if that Personal Information is shared for those third parties’ or affiliates’ own direct marketing purposes.
Pagani does not share Personal Information received related to the Pagani Technical Information Portal with third parties. Notwithstanding, requests for information about Pagani’s Personal Information sharing may be made by contacting us at techinfo@pagani.com.
The CCPA rights and "Shine the Light" rights are derived from separate statutes, and requests must be made separately.

This separate business-to-business notice ("B2B Notice") is directed to individuals in a business or commercial relationship with Pagani related to the Pagani Technical Information Portal.
This B2B Notice describes how Pagani collects, uses, and shares the Personal Information of California residents who interact with the Pagani Technical Information Portal as employees, owners, directors, officers, or independent contractors of another company, partnership, sole proprietorship, non-profit, or government agency (collectively, an "Entity"). It also discloses your rights in your Personal Information under the CCPA, as amended.
