Here at Pagani, we feel that respect for your privacy is fundamental and therefore we ask you to read this notice carefully. In general, all Personal Data (hereinafter also referred to as the "Personal Data" and/or the "Data") that you provide to Pagani or is collected within the context of the use of Pagani services (hereinafter also referred to as the "Services" and/or individually as the "Service") as better defined in the section titled "Personal Data processing purposes" will be processed in compliance with the principles recognised by Personal Data protection legislation in force, such as the principles of transparency, correctness, lawfulness, data minimisation, restriction of purposes and retention, accuracy, integrity and confidentiality.

1. Use Authorization of Pagani Technical Information Portal
The Pagani Technical Information Portal is authorized for use only by public authorities.
2. Data controller
This notice is provided by Pagani S.p.A., with identification details as stated above, in the capacity of Data Controller and with reference to all Personal Data processed through the Site.
Personal data subject to or obtained under this Notice will be processed and stored in the European Union.
3. Personal Data processed
The type and amount of information we collect depends on the choices you make as you interact with the Pagani Technical Information Portal website. We collect personal information about you in different ways and from different sources, as described below.
a. Information You provide to Us.
As you use the Pagani Technical Information Portal website, you may choose to provide information to us, including when you create or modify an account with us, download materials hosted on the website, or make a purchase. As a result of these choices, we may collect some or all of the following information:
Contact Information: Depending on how you choose to interact with the Pagani Technical Information Portal website, we collect personal or business information when you create your registration, or as you may choose to modify your account information. This information includes, but may not be limited to, your name, company, address, phone number, and email address.

Device Details and Network Information: Your device may reveal, and our servers may log, information such as your IP Address, type of device, hardware model, MAC address, operating system, version, settings, configuration, and other network-related information (such as mobile network provider, issuer of your IP Address, or internet service provider).

We reserve the right to combine personal information we collect from any of the above sources.
4. Cookies and Related Technology
The Pagani Technical Information Portal website uses a functional cookie to provide you with access to the information on the website.
A cookie is a small text file or piece of computer code placed on your device’s hard drive to store data that can be recognized by a server on the same domain that placed the cookie. A cookie file can contain information such as a user id that the site uses to track the pages you have visited, but the only personal information a cookie can contain is information you supply yourself. Detecting and preventing fraud.
To comply with and support all applicable laws (“Legislative Compliance”), including:
Compliance with valid inquiries and directives from law enforcement or other government agencies; and
To protect the rights or property of others.
6. Legal basis of processing, compulsory/optional nature of the provision of data
This section sets out the legal bases adopted by Pagani to process Personal Data, according to the purposes specified in the section above titled "Processing purposes".
The provision of Personal Data and the processing thereof for the purposes relating to "Service provision" is strictly instrumental to, respectively, the provision of the service requested and proper performance of the pre-contractual and contractual relationship in place with you - which, therefore, constitute the legal basis. Consequently, in the event of failure to provide the Personal Data required for this purpose or of provision of data found to be incorrect, Pagani may be unable to provide the Service or meet any requests made.
Processing for the "Security and Business Fulfilments" purpose is based on Pagani's legitimate interests and such interests are not overridden by your interests or fundamental rights and freedoms. The legitimate interests we pursue include our interest to manage and maintain the contractual relation between us, to answer your specific questions, and to provide you with access to the materials you have contracted to receive. Furthermore, Pagani's legitimate interests lies in the need to detect and prevent illegal conduct, misuse, or fraud, and to attribute liability in the event of computer crimes against the Pagani Technical Information Portal, Pagani, or third parties.
The provision of Personal Data and the processing thereof for "Legislative compliance" purposes is necessary in order for Pagani to be able to properly fulfil any legal requirements imposed thereon. The Data will be processed according to applicable legislation, which could involve the retention thereof and likewise the disclosure thereof to the competent authorities for accounting, tax, or other requirements.

7. Personal Data recipients
The Personal Data will be made known to the personnel tasked and authorised by Pagani to process Data in order to achieve the aforesaid purposes and these staff members have either undertaken to maintain data confidential or are legally bound to maintain confidentiality.
The Data may be shared, used and transferred (for internal accounting and administration purposes) to the companies in the Pagani Group with registered offices in countries both within and outside the European Union and/or the European Economic Area (given the international presence of Pagani). In the latter case, Pagani guarantees that the data will be processed in compliance with applicable legislation and, therefore, data transfers will be protected by appropriate guarantees pursuant to Chapter V of EU Regulation 2016/679.
The Personal Data will also be made known to third parties designated as data processors in compliance with applicable law, which have been assigned the task of processing Data on behalf of Pagani (for example, IT system and service management companies, suppliers of email platforms, companies with which interaction is necessary for the provision of services, as well as service and consultancy firms, as and when necessary for the performance of their assignments for Pagani, etc.).
Finally, when required, data will be transmitted to financial offices and/or other public administration offices in compliance with the laws in force.
The Personal Data processed will not be published or disseminated.
8. Transfer of Personal Data
Given the Pagani's international presence, some Personal Data may be shared with recipients (as stated in the previous section) who or which may be located in countries outside the EU or the European Economic Area. Pagani guarantees that the data will be processed by these parties solely for the purposes for which it was collected and will be processed in compliance with applicable legislation. Therefore, in the event that data is transferred outside the European Union or European Economic Area, Pagani will adopt all and any contractual measures deemed suitable and necessary to guarantee an adequate level of protection, including – amongst others – adequacy decisions, agreements based on the standard contractual clauses approved by the European Commission, and any other guarantee which may help ensure the level of protection of natural persons guaranteed by EU Regulation 2013/679 is not undermined.

9. Personal Data Retention
The Personal Data processed for the "Service Provision" purpose will be retained by Pagani for as long as is strictly necessary to provide the Service requested and to properly perform the pre-contractual and contractual relationships. Pagani may retain this Data for longer, in particular if this is necessary in order to protect itself against potential liability relating to the Services or the Site.
Personal Data processed for the "Security and Business Fulfilments" purpose will be retained by Pagani for as long as is strictly necessary to achieve this purpose.
Personal Data processed for the "Legislative compliance" purpose will be retained by Pagani for the period established by specific legal requirements or applicable legislation.
Rights of the data subject
Pursuant to Arts. 15 - 22 of EU Regulation 2016/679, each data subject has a series of rights which he or she may exercise at any time, free of charge.
You have the right to obtain confirmation that Personal Data concerning you is being processed and, if necessary, to obtain a copy of such data. You also have the right to obtain access to your Personal Data and further information on the processing in progress. You have the right to have incorrect Personal Data concerning you corrected, updated, or supplemented, as well as to request, where envisaged, deletion of the Data if the processing is deemed unnecessary or unlawful. You have the right to obtain the restriction of the processing if you believe your Personal Data is incorrect or unnecessary, or has been processed unlawfully, or if you have objected to the processing thereof; you also have the right, in the cases provided for by the relevant legislation, to receive your Personal Data in a structured, commonly used, and machine-readable format and the right to request the transmission thereof to another Data Controller. You may also object to the processing of Personal Data concerning you.
More specifically, for the profiling purpose you can always withdraw your consent by following the instructions on how to disable the cookies referred to in the Cookie Policy, or using the acceptance checkboxes on the cookie banner.
If you believe there is a problem in the management of your Data, deeming it to have been processed unlawfully, you may file a claim, at any time, with the national personal data protection authority, in particular with the said authority in the country of residence (for example, in Italy, the said authority is known as the "Garante Privacy"), or in any other country of the European Union or European Economic Area.
The requests referred to in the previous sections must be emailed to the Data Controller at privacy@pagani.com, using the appropriate form available at https://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/1089924 if necessary.
The Data Controller will carry out requests from the data subject to exercise the rights thereof in a timely manner and, in any case, within the time limits established by legislation in force.
